On February 7, 2018, the Ontario Ministry of Housing released the new Standard Form of Lease. This new lease is written in simple language to make it easier for landlords and tenants to understand their rights and obligations under the Residential Tenancies Act 2006. It is also an attempt to reduce illegal and unenforceable conditions in leases and to reduce the number of disputes in the landlords and tenants` room for a solution. If a tenant does not comply with their cleanliness obligations under the law, you can send a letter of formal notice informing your tenant that they must keep the unit clean, a copy of Section 33 of the Residential Tenancy Act may also be attached (which indicates that the tenant is responsible for the ordinary cleanliness of the rental unit). If the tenant still does not surrender, an N5 notice may be sent. The rental deposit can only be used as a rent payment for the last month or last week before the tenant moves out. It cannot be used for anything else, such as repairing the damage done to the rental unit. Ontario`s legislature recently passed Protecting Tenants and Strengthening Community Housing Act, 2020, which grants extended rights to landlords when they enter into a rent-to-pay repayment agreement with their tenants. If the tenant violates the terms and conditions and does not settle the agreed payments, the landlords can file an eviction application with the landlord and the tenants` office. This means that landlords can file an application with the tenant without notice requiring the tenant to pay the money they owe and empty the rental unit. While an order to clear the unit may seem superfluous if the tenant decides not to live in the unit, it would give the landlord the legal right to take possession of the unit and rent it to someone else. A mandatory agreement between the landlord and the tenant can settle disputes in the same way if the tenancy agreement is terminated and the tenant never resides in the rental unit. A landlord may prefer this option if he feels that he could re-rent the apartment to a new tenant, or if he simply does not wish to pursue the lease with a person who would not respect his original agreement.
